1. Acceptance of Terms & Services Description

By accessing the Mets & Associates website or formally engaging our services, you agree to be bound by these Terms and our Privacy Policy. Mets & Associates provides professional contracting and consultancy services, including but not limited to:

General Construction Services: Including but not limited to masonry, concrete works, ceiling installation, plumbing, electrical, painting, welding, and fabrication.
Civil Works: Planning, design, and project management for site development.
Architecture & Plans: Innovative and practical architectural designs for submission for governmental approval.
Cost Management & Estimates: Precise cost management and budget control.
Quotation Provision: Detailed and competitive bids for securing projects.
Tender Development: Comprehensive tender preparation services.
Consultation: Expert advice and insights for construction projects.
Equipment Rentals: A range of reliable construction equipment for rent.

2. Financial Terms and Payment

Payment Structure: Most projects require an initial down payment, followed by a milestone-based payment schedule established in the service contract.
Late Payments: A 10% late fee will be applied to any invoices not settled within thirty (30) days of the due date. Continued failure to pay may result in the immediate suspension or termination of services.
Pricing: All quotations are valid for the period stated therein. Prices for services and rentals are subject to change based on material costs and scope adjustments, which will be confirmed in writing.

3. Client/User Obligations & Conduct

Information Accuracy: Clients must provide accurate and complete information necessary for project execution.
Equipment Rental (Dry Hire): For “dry hire” equipment rentals, the renter is solely responsible for providing certified and competent operators. The client assumes full responsibility for the equipment from the moment of handover to collection, including fuel and daily routine maintenance.
Insurance: Renters are required to provide proof of “Plant & Machinery All Risk” insurance before equipment will be released to their custody.

4. Liability, Disclaimers, and Indemnification

Liability Period: Mets & Associates provides a six (6) month defect liability period following the formal completion of construction projects, as specified in the individual contract.
Limitation of Liability: To the maximum extent permitted by the laws of Trinidad & Tobago, Mets & Associates shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or equipment.
Indemnification: You agree to indemnify and hold harmless Mets & Associates from any claims, losses, or expenses arising from your breach of these Terms or the negligent operation of rented equipment.

5. Intellectual Property

All content on our website and all technical documents, architectural designs, and project plans developed by Mets & Associates remain the intellectual property of Mets & Associates. Clients are granted a non-exclusive, non-transferable licence to use these deliverables solely for the specific project for which they were commissioned.

6. Termination and Governing Law

Termination: We reserve the right to terminate any agreement for material breaches of these terms, including non-payment or failure to provide a safe working environment.
Governing Law: These Terms are governed by and construed in accordance with the laws of the Republic of Trinidad & Tobago. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Trinidad & Tobago.
